My Supervisor Called Me to Disclose My Vaccination Status

MyAPSChoice Group members have been reporting that they are now receiving calls and/or emails direct from their supervisor – who states HR is following up by identifying employees by name that have yet to disclose their vaccine status in 1GX.

What do you do if asked to update 1Gx?

  • Advise them that the Vaccination Policy and Exemption Group are aware of your status and you have been communicating by email.

What do you do if pressed by your supervisor to provide details?

  • Request that your supervisory advise you in writingwho, what and when they were told by HR about anything to do with your vaccination records and what specifically (in detail verbatim) was conveyed to them from your personal medical file?

If your supervisor appears to know the details of your vaccination status or information in 1GX:

  • Inform your supervisor that those records in 1GX plus your information in any potential exemption applications are private, personal, and Protected B and no persons other than the Vaccination Policy / Exemption Teams should be aware of your medical information, as per GoA policy.
  • Inform your supervisor that you have not given any consent for the release, use, or dissemination of any of your medical records, inclusive of your vaccination status, and as such this discussion with your supervisor is a privacy breach.
  • Inform your supervisor your have been in third party contact with the AUPE, GoA Employee Relations, the Human Rights Commissioner, Mr. Ray Gilmour, the Alberta Ombudsman and legal counsel to ensure that all of your private medical information is being protected.
  • Inform your supervisor, that you will be consulting with the Privacy Commissioner to determine if this believed breach of your private medical records is a mandatory reporting requirement by the GoA (your supervisor) to the Privacy Commissioner.

If your supervisor becomes insistent on probing your vaccination status (after the above exchange):

  • Provide them with the Notice of Liability, and ensure their name is written in the template.
  • Keep all records of any written communication.
  • Begin to record any future verbal conversations.
