MyAPSChoice Announcement (Updated Dec 4)

Thank you for reaching out to the MyAPSChoice Group.

Due to the high volume of emails being received, we will no longer be able to personally respond to each request in a rapid manner. However, most of your questions can be answered by keeping up to date on our various website “posts”.

We encourage you to review the MyAPSChoice Resources page daily.

Most of the GoA vaccination mandate deadlines have passed. Therefore, you have either chosen:

Your Current Status:

  • not to consent to anything in 1GX,
  • made a partial declaration of your vaccination status,
  • remained silent on the issue,
  • disclosed some information,
  • are being pressed to complete 1GX,
  • applied for an exemption,
  • are being pressed to complete GoA exemption “forms”,
  • had your exemption denied,
  • have appealed your exemption denial,
  • have made a FOIP request,
  • have filed an AUPE grievance,
  • discussed an accommodation,
  • agreed or disagreed to testing,
  • or communicated a personalized concern / objection to the vaccination policy group.

Regardless of your current position, the responsibility now mostly falls on the GoA to determine how they will react to your lawful resistance.

MyAPSChoice’s Legal Counsel will continue to file petitions and formal letters of complaint on your behalf, however, should the GoA escalate to any “disciplinary action” against you (based on your definition) then you will need to take the appropriate steps to protect yourself from such wrongful action.

Remember, any punitive action by the GoA could be interpreted as retaliatory because you are a complainant in many current investigations. Refer to the post: https://myapschoice.ca/stand-fast-complaints-pending-investigation/

Most Recent Recommended Action Items:

  1. If your exemption request based on Human Rights Protected Grounds, is denied, you are encouraged to file a personal complaint with the Alberta Human Rights Commissioner. If they try to persuade you otherwise, stand firm as you are entitled to file a complaint.
  2. If your exemption request based on Human Rights Protected Grounds, is denied, you are encouraged to appeal the decision ASAP. Your grounds for appeal may be similar to this legal opinion.
  3. If your exemption request based on Human Rights Protected Grounds, is denied, submit a FOIP request ASAP.
  4. If the GoA continues to press you to complete your exemption request on “their” form, respond firmly by stating that they are required by law under the Alberta Human Rights Act to accept your submission plus disclosure in any format that you are claiming Human Rights accommodation based on protected grounds. Use the MyAPSChoice template.
  5. If the GoA continues to press you to complete your exemption request on “their” form, you can also file a personal complaint with the Human Rights Commissioner stating the GoA is refusing to accept your exemption request.
  6. If the GoA continues to press you to complete the 1GX form, respond by advising them that the Vaccination Policy and Exemption Group are fully aware of your vaccination status and/or are in possession of all of your information.
