STAND-FAST – Complaints Pending Investigation

Should any of you as MyAPSChoice Group Members (those who have signed the open letter) be confronted by the GoA Vaccination Policy or Vaccination Exemption teams for not adhering to the policy and/or the process… politely advise them:

“… I am a complainant in several formal oversight agency investigations. These entities are examining, evaluating, and adjudicating over the lawfulness and appropriateness of the GoA vaccination policy. Therefore, pending the results of these independent investigations, any further direction or action from the GoA for me to comply to the GoA vaccination policy under duress or face consequences – would equate to a retaliatory measure, and in some instances a statutory offence. Consequently, it is inappropriate for me to respond to you at this time…”

If and when this occurs, obtain the full particulars of the person and department and retain any documented communication – likely to be used as evidence.

Any such aggression shall be reported by the MyAPSChoice Group as a new complaint allegation to be investigated and adjudicated.

Investigations currently underway or pending include but are not limited to:

  • Harassment & Discrimination – Filed with Employee Relations by MyAPSChoice
  • Unlawful, Discriminatory and Unfair Employer Practices – Filed with the AUPE by MyAPSChoice
  • Discrimination on Protected Grounds – Filed with the Human Rights Commission by MyAPSChoice
  • Administrative Unfairness – Filed (tba) with the Office of the Alberta Ombudsman
  • Contravention of Act of Parliament – Filed (tba) with the Public Interest Commissioner
  • Gross Mismanagement – Filed (tba) with the Public Interest Commissioner
  • Harmful Worksite – Filed (tba) with Occupational Health & Safety
  • Statement of Claim – Filed with the Court of Queen’s Bench by Legal Counsel for MyAPSChoice
